ABSTRACT

The law of Sedition is a century-old law that has been used as a justification to suppress rebellions and uprisings against the monarch and governmental authority, However, in modern times it creates a question if people should be convicted for voicing their opinion criticizing or showing their dissatisfaction to any attributes of the government. Constitutions around the world have acknowledged that Free Speech and Expression is a very basic human right and moreover, it’s the job of the citizens to keep the functioning of the government in check. In doing the job, there would be a clash between the basic fundamental right and the legislature that criminalizes criticism of the government. In the current day scenario, most of the countries have realized the nuisance behind it and have successfully passed legislation against the sign of colonialism. In this paper, we would see how India views sedition, its ties to the colonial past, and how other countries have managed to deal with this law confirming the basic human rights of its citizens
